Terms and Conditions of Sale
The company AUGUSTIN, a French SARL with share capital of €11,434 (hereinafter THE SELLER), is registered with the Roubaix-Tourcoing Trade and Companies Register under number RCS B 405 360 470. Its postal address is 52-54, rue de Roubaix, 59200 TOURCOING, France, and its email address is contact@boutique-augustin.com (hereinafter THE SELLER'S ADDRESS).
Placing an order implies the customer's acceptance, without any restriction, of the Terms and Conditions of Sale of our online store.
Delivery
The delivery times shown on the order form are given for information only, and any delay does not entitle the buyer to cancel the sale, refuse the goods, or claim damages. Any complaint regarding non-conformity or missing items must be sent within one week of the date the order is received.
Our online store is released from its delivery obligation in the event of any fortuitous event or force majeure. By way of example, total or partial strikes, floods and fires are considered cases of force majeure.
Ownership of the delivered or to-be-delivered products is suspended until full payment of the price by the customer, without affecting the transfer of risk.
Product availability
Our product offers on the Site are valid only while stocks last. If a product becomes unavailable after your order has been placed, we undertake to inform you within 48 hours and to indicate the expected waiting time for receiving that product. If you wish, you may request the cancellation or exchange of your order by calling us or contacting us by email.
Order confirmation
Contractual information will be confirmed by email to the address provided by the consumer on the order form.
Product information
Product and manufacturer names and brands are used for identification purposes only. Product photos, descriptions and prices are not contractually binding.
Our prices may be changed without notice. Our online prices include tax (VAT) for France and the European Union, and are exclusive of tax for other countries.
Delivery terms
Products are delivered to the address given by the consumer on the order form, and only to the geographical areas we serve.
Right of withdrawal
The right of withdrawal applies only to private individuals.
In accordance with articles L. 120-20, the consumer has a period of seven calendar days to return, at their own expense, any products that do not suit them. This period runs from the day the consumer receives the order. Any return must first be reported to THE SELLER's customer service. The product must be returned to THE SELLER'S ADDRESS.
Only products returned complete, in their full and undamaged original packaging, and in perfect resale condition will be accepted. Any product that has been damaged, or whose original packaging has been damaged, will not be refunded, accepted for return, or exchanged. This right of withdrawal may be exercised free of penalty, except for shipping and return costs. Should the right of withdrawal be exercised, the consumer may choose either a refund of the amounts paid or an exchange of the product. In the case of an exchange, return shipping will be at the consumer's expense.
Should the right of withdrawal be exercised, AUGUSTIN sarl will make every effort to refund the consumer within thirty days.
Usage rights
The use of the trademarks, photos and texts appearing on the site is strictly prohibited.
Applicable law
These general terms and conditions are governed by French law, both in substance and in form.
In the event of a dispute or complaint, the consumer should first contact THE SELLER to seek an amicable solution.
Protection of personal data
Under French law no. 78-17 of 6 January 1978 on information technology, data files and civil liberties, you have the right to rectify, consult, modify and delete the data you have provided to THE SELLER.
In the case of a sale to a legal entity, any dispute relating to the sale (price, Terms and Conditions of Sale, products, etc.) shall be governed by French law and submitted to the Commercial Court of Lille Métropole.
